Justice of the Supreme Court of Croatia, and President of the Council of Europe Group of States Against Corruption (GRECO)

The seminar will focus on the similarities and differences between Anglo-Saxon and continental criminal law and fair trial procedure. Judge Mrcela will discuss the European Convention on Human Rights and Fundamental Freedoms and changes in the court practice in Croatia.

Justice Mrcela has his Ph.D. from the Zagreb Law Faculty, University of Zagreb, and was a Hubert Humphrey Fellow at the American University, Washington, D.C. from 2000 -2001. He is Vice-President of the Association of Croatian Judges and is a Council of Europe Expert in the field of Criminal Law (corruption, organized crime, criminal procedure).

Description: Effective on April 1, 2017, Chinese patent office (SIPO) will consider software-based computer methods (no longer non-patentable subject matter), post-filing data supplement, and certain flexibility in claim amendment during invalidation proceedings.  In light of these changes and in combination with real-life experience enforcing or defending IP rights for US companies in China, Dr. Zhu will discuss a variety of topics including:

      • The reality of patent enforcement in China
      • The underlining difference in patent litigations between the US and China that leads to frustration or misconceptions of US counsel and companies
      • The improving IP court system in China
      • The impact of the changing patent regulations in favor of patent holders
      • Strategies for US companies to:
        —Ease qualms about PRC patent litigation
        —Leverage the difference between patent laws in the US and China
        —Obtain enforceable IP rights to defend or enforce these rights against potential infringers or competitors (not necessarily just domestic China companies) in the world’s second largest marker.

       

    • Dr. James J. About the Program:
Jeffrey Wilson will speak on the latest developments in PRC labor and employment law, including the efforts by the PRC government to limit the increase in labor costs as well as to create flexible labor markets. He will also discuss experiences working with many of the largest American and European companies on their labor and employment work in China, including worker unrest and dispute resolution in arbitration tribunals and courts. He also plans to cover the recent tightening of laws governing foreigners working in China as well as the rules for foreign students to take internships in the country.

About Jeffrey Wilson:
Jeffrey Wilson is counsel at JunHe LLP Shanghai and a member of the firm’s employment and labor practice. JunHe is the oldest private law firm in China and still one of the country’s largest firms. JunHe’s employment and labor practice is consistently ranked Tier 1 by Chambers and Partners with Jeffrey being one of two ranked foreign legal consultants on PRC employment and labor law.

He is a frequent speaker on PRC labor issues in China, Europe and the United States. He has also assisted the American Chamber of Commerce in Shanghai to prepare comments on draft legislation and regulations.

Jeffrey was born and raised in Corvallis. He received his undergraduate degree from Lewis and Clark College in Portland, Oregon, and his law degree and M.A.I.S. degree in Chinese Studies from the University of Washington in Seattle. He also studied Mandarin at National Taiwan University. He first went to China in 1986 to teach at Fuzhou University and source products for Atiyeh International. He also worked at Portland’s Norcrest China Company, which was located in the White Stag building.

He is Chairman of Active Kidz Shanghai, which is the largest youth sports organization serving the international community in Shanghai.

Women in International Law Mentoring Program

CALL FOR MENTORS!  CALL FOR MENTEES!

The American Society of International Law (ASIL) and its Women in International Law Interest Group are excited to announce the launch of the fourth year of the Women in International Law Mentoring Program.

Since 2013, over 364 women have enrolled in ASIL’s Mentoring Program as both mentors and mentees in 9 countries and 27 cities from Tucson to Singapore. The feedback has been extremely positive, and the current participants have built a strong, inter-connected, and global network. ASIL hopes to reach more women for the 2016-17 program!

The Women in International Law Mentoring Program is the first of its kind in international law and is designed to foster the next generation of female international lawyers. The program connects experienced female international law professionals with female law students and new attorneys interested in professional development in the field of international law. Mentoring takes place locally, in a group setting, with a maximum of four mentees for every mentor. Mentors and mentees meet in person every other month during the course of an academic year to discuss topics and engage in activities designed to help junior women enter and be successful in the beginning years of practicing international law. Upon finishing the requirements of the one-year program, all participants receive a certificate of completion.

ASIL is currently accepting applications for mentees and mentors. In particular, ASIL strongly encourages potential mentors to join the Program. If you are considering participating, please sign up. Mentors truly make this program possible, and ASIL does all that it can to make the experience fulfilling and hassle-free.

Obtaining Foreign Discovery and Offering it into Evidence

  • The Strangest Venue:  Representing Clients at the United Nations

    The United Nations was created in 1945 after World War II to promote international peace and security, human rights, and friendly relations among nations.  Today, the UN is one of the primary forums for the negotiation of international law, although the process is unfamiliar to most practicing lawyers.  Oregon lawyer and former legislator, Thomas Mason, has over 17 years’ experience representing clients in the UN, and was recently involved in the negotiation of the UN Arms Trade Treaty.  Mr. Mason will discuss the UN, its legal culture, and representing clients through the treaty-making process.Thomas Mason joined the Oregon State Bar in 1976.  He was a member of the Oregon Legislature from 1979 to 1993 and became associated with the United Nations when he was appointed to the Society for the Reform of Criminal Law, a UN-affiliated think tank in Vancouver, BC, in 1992.  In 1995, Mr. Mason began representing several nongovernmental organizations to the UN.  His clients include international hunters, firearms user groups, and both civilian and military firearms manufacturers.  He has made numerous presentations to UN conferences, meetings, and the First Committee on Disarmament of the UN General Assembly.  His most recent involvement was with the just-completed UN Arms Trade Treaty.

    China is one of Oregon’s largest trading partners, but it can also be a daunting market to navigate.  Since 2002, Representative Richardson has led numerous trade missions to China.  He will share his insight into the Oregon-China relationship, discussing his recent trade mission to China, Oregon-China trade relations and opportunities generally, and how Oregon lawyers might play a role in Oregon-China trade.  Ambassador Wenaweser will provide an overview of the history and mandate of the ICC and the results of the ICC Kampala Review Conference held in Kampala, Uganda in 2010.  The Conference delegates reviewed the Rome Statute System (which created the International Criminal Court in 1998) and sought to chart a course for the future of international criminal justice.
Ambassador Wenaweser will also address current challenges, in particular the situation in Syria, discussions concerning Africa and remarks on the US and the ICC.The United States, while supportive of the work of the ICC, is not a participant.

Yale Law Professor Paul W. Kahn has analyzed the US opposition to the International Criminal Court in an article “Crimes of War”. Kahn argues that the jurisdiction of the Court has become the site for a symbolic battle between law and politics for the US.

        Catholic Charities Immigration Legal Services will be training attorneys on U Nonimmigrant Status for Immigrant Victims of Serious Crimes on Thursday, August 8, 2013.  The training will be held on the 4th floor of the Catholic Charities building at 2740 SE Powell Boulevard in Portland, from 10am to 2:30 pm.  Presenting the training will be several experienced members of the staff of Catholic Charities Immigration Legal Services.
        The training is introductory, but you will emerge from the training knowing the U Visa well enough to represent a pre-screened Catholic Charities client and his or her family members pro bono, with technical supervision from Catholic Charities if you so require.         Please join us for a discussion of some of the most pressing and controversial issues confronting businesses, governments, and stakeholders today, all relating to one basic dilemma: how to balance economic development and the pursuit of profit with environmental and social priorities. In recent years the United States and many other countries have concluded a vast network of investment treaties, which offer an array of benefits and protections to businesses involved in international investment, and have contributed to a dramatic growth in foreign investment both into and out of this country. And talks are underway to conclude even more treaties, including the controversial Trans-Pacific Partnership, which could (among other things) encourage investment in efforts to export coal from the Pacific Northwest to Asia. While businesses and governments have lauded these treaties, critics have denounced them for promoting investment without imposing obligations on investors to ensure fair treatment of workers and local communities and the use of environmentally-friendly practices and technology. This forum will explore tensions between the potential of international investment to promote economic development and the drawbacks associated with it, as leading scholars from the United States, Canada, and Europe consider whether investment treaties and other sources of international investment law are compatible with sustainable development, how they could be modified in the future to promote a better balance, and how voluntary efforts by businesses can help as well.

        The Portland-Mutare, Zimbabwe Sister City Association is holding its annual fundraiser for Mutare programs on December 1, 2011. All of the net proceeds return to Mutare. Your ticket could pay a child’s school fees for 3 quarters.

        Twenty years ago, Portland formed a sister city relationship with Mutare, Zimbabwe. Zimbabwe was once the breadbasket of Africa, but now suffers from weak agricultural output, electricity shortfalls, and crippled health and educational systems. A board of about 15 Portland Metro residents serve as volunteers, holding fundraisers to, among other things:

        – develop school aid programs
        – build a clinic and supply an ambulance
        – donate clothing and glasses
        – provide computer equipment

      If you have ever run across ADR provisions in standard contract “terms and conditions” and have wondered what they really mean and want to be in a position to assess them meaningfully, this program will help you to do just that. For attorneys who have clients that engage in any substantial international business transactions (whether in a purchase/sale context, distribution or agency arrangements, mergers and acquisitions, or the like), this program will help you form and solidify a basis for understanding ADR provisions that you have probably encountered in your practice. We hope that lawyers who have substantial experience in this area of law, as well as those who may be new to it, will attend this program.       With the passage of the Sarbanes-Oxley Act (“SOX”) and other whistleblower protection statutes, many U.S. companies are required to implement confidential and anonymous whistleblower reporting systems. U.S. companies with international operations that have begun to implement reporting systems abroad have faced resistance and complications caused by cultural barriers, language differences and conflicts in complying with the various laws of the jurisdictions in which such organizations operate. Given that international firms traded on U.S. Exchanges by American Depository Receipts must be compliant with SOX 301 guidelines by July 31, 2005, these barriers will soon need to be overcome in order to ensure international compliance with SOX.       Michael Doyle has been the Director of the International Division of the Oregon Economic and Community Development Department (OECDD) since January 2000.
